Hiriwā Digital Art, based in New Zealand, operates this website and store, powered by Shopify. This Privacy Policy explains how we collect, use, store and share personal information when you visit our website, purchase products, arrange a portrait session or contact us.
Depending on how you interact with us, we may collect:
Payments are handled by Shopify and the payment providers available at checkout. We receive payment and transaction information needed to manage your order; we do not receive your full payment card number or security code.
We collect information directly from you when you place an order, arrange a session, supply photographs, complete a form, choose your privacy preferences or communicate with us.
We also receive information from Shopify, payment providers and other services involved in operating our store and fulfilling orders. Some technical and usage information is collected automatically when you use our website.
If someone arranges a gift or portrait on your behalf, we may receive information they provide about you. Where required, we will notify you about that collection and how the information will be used.
We use personal information to:
Providing certain information is necessary to process an order or create a portrait. If you choose not to provide it, we may be unable to provide the requested service. Promotional permission is optional and is not required to purchase a portrait.
We use supplied photographs, iris photographs and associated customer details to create and deliver your commissioned artwork, communicate with you and manage related requests.
Where printing or other production services are required, we share the artwork and necessary order details with the providers fulfilling your order.
Please supply photographs only where you have the necessary rights and permission for us to use them for your commission. If photographs include other people, please make them aware of how their information will be used.
Copyright arrangements are explained in our Terms of Service. Copyright ownership does not, by itself, provide permission to publish a customer’s portrait for promotion.
Sharing your portrait for promotional purposes is optional.
If you tick “You may share my finished portrait” on the portrait order form, you give Hiriwā Digital Art permission to display your finished portrait in its website gallery, social media, market displays and promotional materials. This may include printed displays and online posts available to the public.
If you leave the sharing checkbox unticked, we will keep your portrait private. Accepting our terms, acknowledging this Privacy Policy, submitting an enquiry or purchasing a portrait does not, by itself, provide promotional permission.
This permission does not authorise selling your portrait as a product, publishing your contact details or original reference photographs, or identifying you by name without separate permission.
You may give permission only for yourself or where you have authority to act for the person concerned. For portraits involving more than one person, permission must cover everyone whose portrait will be shared.
We may also record promotional permission through a separate written agreement. Publishing or updating this policy does not retrospectively provide permission for earlier portraits.
Permission continues until you withdraw it. You can use our Contact page to withdraw permission for future promotional use and request removal from channels we control.
We will stop new promotional use and take reasonable steps to remove existing material from those channels. Printed material already distributed, or content copied or shared by others, may not be retrievable.
Withdrawing permission does not affect use that was lawful before withdrawal. It does not cancel your order or remove records we need to retain for other lawful purposes.
Our website and checkout are intended for adults. A parent or guardian should arrange purchases and portrait sessions for a child and authorise the collection and use of the child’s photographs for that commission.
Any promotional permission for a child’s portrait must come from a parent or guardian with authority to give it, taking the child’s views into account where appropriate. Booking a session or purchasing a gift voucher does not, by itself, provide permission to share the child’s portrait.
If you have concerns about information relating to a child, please contact us.
We share personal information where necessary with service providers that help us operate our business, including:
We share the information reasonably needed for the relevant purpose. We may also share information where you request or authorise us to do so.
Where you give promotional permission, your finished portrait may be visible to the public through the channels described above.
You may unsubscribe from marketing emails using the unsubscribe link provided or by contacting us. We may still send messages needed to manage your order, booking or other service request.
Permission to share your portrait is separate from subscribing to marketing emails. Selecting one does not automatically select the other.
Shopify hosts our store and processes information to provide, secure and improve its services. Our website uses cookies and similar technologies for functions such as maintaining your cart, remembering preferences and understanding website activity.
Depending on the features enabled and your privacy choices, Shopify and connected services may also process information for analytics, personalised experiences and advertising. Where required, we request consent before using non-essential cookies or related technologies.
You can manage cookies through your browser and any privacy controls available on our website. Disabling some cookies may affect website functionality.
For information about Shopify’s practices and privacy choices, visit the Shopify Consumer Privacy Policy and Shopify Privacy Portal.
We take reasonable steps to protect personal information against loss, misuse and unauthorised access, alteration or disclosure. No method of electronic storage or transmission is completely secure.
We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including fulfilling orders, managing commissions, resolving enquiries and meeting legal obligations.
Retention periods may differ for order records, correspondence, source photographs, finished artwork and records of promotional permission. Keeping copyright in artwork does not mean we may retain associated personal information indefinitely.
You can contact us to ask about the information, photographs or artwork we hold in connection with your order and request deletion where applicable. We will explain any limits, including legal retention requirements and the handling of backup copies.
Shopify and other service providers may store or process information outside New Zealand. Promotional material published online may also be accessible overseas.
Where applicable, we take reasonable steps to ensure overseas disclosures comply with New Zealand privacy requirements and other laws that apply, including using appropriate contractual safeguards where required.
Under New Zealand privacy law, you can request access to personal information we hold about you and ask us to correct information that is inaccurate, incomplete or misleading.
If we do not make a requested correction, you may ask us to attach a statement recording the correction you sought, as provided by applicable law.
Depending on where you live, you may also have rights to request deletion, restrict or object to processing, receive a portable copy of your information or withdraw consent.
These rights are subject to applicable legal limits. We may need to verify your identity or authority to act for someone else before responding. We will respond within the timeframes required by applicable law and explain any lawful grounds for declining a request.
Our website may link to other websites or services. Their privacy practices are governed by their own policies. Please review those policies before providing personal information.
For privacy questions, requests or complaints, please use our Contact page and address your message to the Privacy Officer.
If we cannot resolve your concern, you can contact the New Zealand Office of the Privacy Commissioner or the relevant privacy authority where you live.
We may update this policy to reflect changes to our services, practices or legal obligations. We will publish the updated version here and revise the date above, with additional notice where required.
A policy update does not expand any promotional permission you previously gave. We will obtain further permission where needed for a new use.
Welcome to Hiriwā Digital Art. The terms “we”, “us” and “our” refer to Hiriwā Digital Art, based in New Zealand. Our online store is powered by Shopify.
These Terms of Service apply when you use our website or purchase our products and services. Please read them alongside our Shipping Policy, Refund Policy and Privacy Policy.
Nothing in these terms excludes, restricts or limits rights or remedies that cannot lawfully be excluded, including those available under the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986, or mandatory consumer laws that apply where you live.
You must be legally able to enter into a purchase agreement or have the involvement and authorisation of a parent or guardian. A parent or guardian should arrange purchases and portrait sessions for a child.
Please provide accurate and current contact, payment and delivery information. If you create an account, you are responsible for keeping your login details secure and notifying us of suspected unauthorised use.
You must not use our website for unlawful purposes, submit fraudulent information, infringe another person’s rights, distribute malicious software or interfere with the website’s security or operation.
We take care to describe and photograph our products accurately. Colours may vary between screens and printed materials. Natural materials, including reclaimed timber, may vary in grain, colour and texture.
Product dimensions, materials, finishes and included items are described on the relevant product page. Please check these details and your selected options before ordering.
Normal variations do not affect your rights where goods are faulty, materially different from their description or otherwise fail to meet applicable consumer guarantees.
We may update our range, descriptions and availability. Changes do not alter an accepted order unless we agree with you or a change is required by law.
When you place a paid order, you authorise payment of the total shown at checkout using your selected payment method. An automated order acknowledgement confirms receipt of your order; it does not necessarily confirm that we can fulfil it.
A free portrait enquiry does not itself require payment. The process, prices and payment stage for a commission are described on the relevant service page or agreed with you directly.
If we cannot fulfil your order, or identify an availability, pricing or payment issue, we will contact you as soon as reasonably possible. If we cancel an order, we will refund payments received for the cancelled items and any associated delivery charges that are no longer payable.
Please review your order carefully and contact us promptly if anything is incorrect.
The applicable currency, product prices, discounts, shipping charges and any taxes collected by us are shown at checkout. Please check the final total before placing your order.
Prices and promotions may differ between our website, markets and other sales channels. Changes to prices do not retrospectively change an accepted order.
Promotions may have additional conditions stated with the offer. Overseas orders may incur import charges that are not collected at checkout, as explained in our Shipping Policy.
Available destinations, shipping methods and charges depend on the products and delivery address in your order. Please refer to our Shipping Policy for production and delivery information.
Production and delivery estimates are separate unless stated otherwise. Delivery estimates may be affected by carrier operations, customs processing, weather and other events.
If we arrange delivery and your order is lost, damaged or significantly delayed, please contact us so we can investigate with the carrier and provide an appropriate resolution. Our responsibilities and your remedies remain subject to applicable consumer law.
Please check your delivery address carefully. If you provide an incorrect address, contact us as soon as possible. Any additional delivery costs will depend on the circumstances and applicable law.
Products in one order may be dispatched separately. Any combined shipping charges will be shown at checkout.
The relevant product page or written agreement describes what is included in your commission, including the format, size, number of subjects and any included editing or revisions.
You are responsible for providing the photographs, instructions and approvals reasonably needed to complete your order. Delays in receiving these may affect completion times.
When supplying a photograph, you confirm that you have permission from its copyright owner and any necessary permission from the people shown for us to use it to fulfil your commission. Owning a copy of a photograph does not necessarily mean you own its copyright.
Portraits involve artistic interpretation. The quality and detail achievable may depend on the source photographs or images captured during a session. We will discuss material limitations with you where relevant.
For a child’s portrait, the booking or commission must be arranged by a parent or guardian with authority to do so.
Where a product includes digital files, the listing or written agreement will describe what you receive. Physical prints, framing and other products are included only where expressly stated.
You may download and keep your delivered files, share them for personal, non-commercial purposes and arrange personal prints. Please keep a backup of your files after delivery.
Commercial reproduction, licensing or resale of commissioned artwork requires a separate written agreement. This does not prevent you from giving your purchased physical print as a gift or exercising rights that cannot lawfully be restricted.
The value or service covered by a gift voucher, how it can be redeemed and any applicable conditions will be stated on the voucher or its product listing.
Please check these details before purchasing. Gift vouchers remain subject to applicable consumer law, including any mandatory expiry requirements.
Purchasing a portrait gift voucher does not give permission to publish the recipient’s portrait. Any promotional permission must be obtained from the relevant person or an authorised parent or guardian when the service is arranged.
Please contact us as soon as possible if you need to change or cancel an order. Our ability to accommodate a voluntary change or cancellation depends on whether work, production or dispatch has begun.
We do not accept change-of-mind returns or exchanges except where required by applicable law. Please see our Refund Policy for details, including any cancellation rights that apply to international customers.
These conditions do not affect your rights where goods or services are faulty, not as described or otherwise fail to meet applicable consumer guarantees.
Copyright and other intellectual property rights in our existing artwork, website content, branding and product designs belong to Hiriwā Digital Art or the relevant rights holder.
Buying a print or another physical product featuring our existing artwork does not transfer copyright or grant permission to reproduce that artwork for sale or commercial use.
By booking or commissioning our portrait service and accepting these terms before work begins, you agree that Hiriwā Digital Art retains copyright in the original artwork and photographs it creates for your commission, unless we agree otherwise in writing.
This copyright agreement does not transfer ownership of photographs or other materials you supply to us. Those materials remain subject to their existing ownership rights. You authorise us and the providers fulfilling your order to use them as reasonably necessary to create, produce and deliver your commission.
You may display your purchased portrait and use any included digital files as described in Section 7. Our copyright ownership does not, by itself, authorise promotional use of your portrait; that is addressed separately in Section 11.
These terms do not retrospectively change copyright ownership in earlier commissions or limit rights that cannot lawfully be excluded.
You must not copy or commercially exploit website content or artwork without permission from the relevant rights holder, except where permitted by law.
Promotional use is optional and is separate from accepting these terms.
If you leave the sharing checkbox unticked, we will keep your portrait private. Accepting these terms, submitting an enquiry or purchasing a portrait does not, by itself, give promotional permission.
You may give promotional permission only for yourself or where you have authority to act for the person concerned. Where a portrait includes more than one person, permission must cover everyone whose portrait will be shared. For a child’s portrait, permission must come from an authorised parent or guardian, taking the child’s views into account where appropriate.
Permission continues until you withdraw it. You can use our Contact page to withdraw permission for future promotional use and request removal from channels we control. We will stop new promotional use and take reasonable steps to remove existing material from those channels. Printed material already distributed, or content copied or shared by others, may not be retrievable.
We may also record promotional permission through a separate written agreement. A new version of these terms does not retrospectively provide permission for earlier portraits.
If you submit a review for publication, you give us permission to display it with the name or display name you provide and to make minor formatting changes without changing its meaning.
Reviews must reflect your experience and must not contain unlawful material, misleading claims or another person’s private information without permission.
Submitting a photograph for a commission or sending us a private message does not, by itself, give permission to publish it as a review or promotional material.
Our website may link to third-party websites or offer services provided by other businesses. Please review their terms and privacy policies when using those services.
Where a listing expressly directs you to purchase from another business, that purchase is made with that business and is subject to its terms. This does not limit our responsibilities for products or services you purchase directly from us.
Shopify provides the platform that enables us to operate this store. Purchases from this store are made directly with Hiriwā Digital Art, not Shopify.
Shopify is not the seller of our products or services and is not responsible for fulfilling our orders. Nothing in these terms excludes any responsibility or liability that cannot lawfully be excluded.
Our Privacy Policy explains how we handle personal information, including customer details, portrait photographs and promotional permissions.
Shopify also processes information to operate its platform. You can read the Shopify Consumer Privacy Policy for more information.
We take reasonable care to keep website information accurate and the store functioning properly, but occasional errors or interruptions may occur.
We may correct errors in descriptions, availability or pricing. If an error affects an order you have placed, we will contact you and explain the available options rather than make a material substitution or increase an agreed price without your consent.
We remain responsible for meeting obligations imposed by applicable consumer law. Nothing in these terms removes your right to an available repair, replacement, refund or other remedy.
Any limitation or exclusion of liability in these terms applies only to the extent permitted by law. We do not exclude liability that cannot lawfully be excluded.
If an event outside our reasonable control affects an order, we will communicate with you and take reasonable steps to address the situation. Such an event does not automatically remove your statutory rights.
These terms are governed by New Zealand law, subject to any mandatory consumer protections that apply where you live.
Please contact us first if there is a problem so we have an opportunity to resolve it. Nothing in these terms prevents you from using an available tribunal, court, regulator or other dispute-resolution process.
We may update these terms by publishing a revised version and updating the date above. Changes apply to future use and purchases and do not retrospectively alter an existing order unless agreed with you or required by law.
If any provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
If you have questions about these terms or an order, please use our Contact page.
We do not accept change-of-mind returns or exchanges. Please choose carefully and check the artwork, size, materials and selected options before ordering.
This applies to our standard products and custom artwork, subject to any mandatory consumer rights described below.
If your order arrives damaged, please contact us as soon as reasonably possible with your order details and photographs of the damaged item and packaging.
Our standard response is to arrange a replacement at no additional cost, including replacement shipping. If you are legally entitled to a different remedy, we will honour that right.
Please retain the item and packaging where possible while we investigate. Do not send anything back unless we arrange it with you. If a return is necessary, we will provide instructions and cover reasonable return costs where required by law.
Where we arranged delivery, we will handle the carrier investigation. Your remedy will not depend on you resolving a claim with the carrier.
If your order is faulty, incorrect or materially different from its description, please contact us with your order details and a description of the problem.
We will investigate and provide an appropriate remedy under applicable consumer law. Depending on the circumstances, this may include a replacement, repair or refund.
Your statutory rights also apply to personalised artwork, digital files, portrait services and discounted products.
Please contact us promptly if you need to change or cancel an order. We cannot guarantee that a change-of-mind request can be accommodated once artwork, production or dispatch has begun.
This does not limit any cancellation rights available under applicable law.
Where EU or UK distance-selling cancellation rules apply, customers generally have 14 days after receiving eligible goods to notify us of cancellation and a further 14 days to return them.
Exceptions may apply to goods made to the customer’s specifications or clearly personalised. Producing a standard print after ordering does not automatically make it exempt.
For an eligible cancellation, we refund the purchase price and standard outbound delivery cost. Refunds are due within 14 days of cancellation notice, but may be withheld until we receive the goods or evidence of return, whichever comes first, where legally permitted.
You are responsible for direct return shipping costs for these cancellations unless applicable law requires otherwise. A lawful deduction may apply for handling beyond what is necessary to inspect the goods.
Any statutory cancellation rights for services or digital content also remain applicable.
Where a refund is required, we will process it within the applicable legal timeframe, normally using the original payment method. Your bank or payment provider may need additional time to display it.
Nothing in this policy excludes or limits rights under the New Zealand Consumer Guarantees Act 1993 or other applicable consumer protection laws.
For damaged items, order problems or policy questions, please use our Contact page.
Thank you for shopping with Hiriwā Digital Art. This policy explains order processing, shipping charges and delivery.
Fine art prints, canvas prints and framed prints are made to order. Please allow 5–7 business days for printing and production before dispatch.
For pet portraits, printing and production begin once the artwork has been completed and approved and payment has been received. The production timeframe does not include the time needed to create your portrait.
Processing times for other products depend on availability and any information provided on the product page. Please contact us before ordering if you need an item by a particular date.
During busy periods, production may take longer. We will contact you if we become aware of a significant delay affecting your order.
Available shipping methods, charges and any delivery estimates are shown at checkout. Please allow for production time in addition to delivery time.
Delivery estimates begin once your order has been dispatched. Carrier operations, weather, customs processing and public holidays may affect delivery.
If you have a deadline, please contact us before purchasing so we can discuss whether it is achievable.
Shipping charges are calculated at checkout based on your delivery address, the products and sizes in your order, and your selected shipping method. Rural or remote delivery charges may apply, as shown at checkout.
Free NZ shipping applies to eligible website orders of $100 NZD or more, excluding Pet & Iris Portraits.
Any shipping charges payable for your order will be shown before you complete your purchase.
International shipping is available for eligible products to destinations supported at checkout. Availability depends on the products, sizes and delivery address in your order.
International shipping charges are calculated at checkout. The free NZ shipping offer does not apply to international orders.
Products in the same order may be produced or dispatched separately and may arrive at different times. Shipping charges for separate shipments may be combined at checkout.
You will not be charged additional shipping after purchase without your agreement.
International orders may be subject to destination-country taxes, customs duties, import charges, and carrier brokerage or handling fees.
Any charges collected at checkout will be identified before you complete your purchase. Unless checkout expressly states that duties and taxes are prepaid, additional charges may be payable before or at delivery.
Charges not included in your checkout total are your responsibility unless otherwise stated or required by applicable law. The amount depends on your destination and the applicable import rules.
Customs processing may also delay delivery. Please check your local import requirements before ordering.
Once your order has been dispatched, we will send shipping confirmation and tracking details where available. Tracking information may take time to appear on the carrier’s website.
If your order is sent in separate shipments, you may receive more than one tracking notification.
Where your purchase includes digital files, these are supplied electronically according to the relevant product or service details. Physical prints and shipping are included only where expressly stated.
Please check your delivery address carefully before completing checkout. If you notice an error, contact us as soon as possible.
We may be unable to change the address once an order has been dispatched. If an incorrect or incomplete address results in a returned parcel or requires redelivery, we will discuss any additional costs with you before resending it, subject to applicable law.
If your order has not arrived, arrives damaged or appears to be lost, please contact us. Where we arranged delivery, we will investigate with the carrier and work with you to resolve the issue.
For damaged items, please retain the item and packaging where possible and send photographs to help us investigate. We will provide an appropriate remedy in accordance with your consumer rights.
If you need to change or cancel an order, please contact us promptly. Our ability to accommodate a change-of-mind request depends on whether artwork, production or dispatch has begun.
Please see our Refund Policy for return and cancellation information. Nothing in this policy limits cancellation or refund rights available under applicable law.
This policy does not exclude or limit your rights under the New Zealand Consumer Guarantees Act 1993 or other applicable consumer protection laws.
Please use our Contact page if you have questions about shipping or your order.
